Corpus Delicti and DUI Cases
It is a rule of criminal law that a criminal conviction requires independent proof of the corpus delicti. In a misdemeanor DUI case for instance where the person is no longer in the car but admitted that he or she was the driver to the police officer, the prosecution must raise a reasonable inference with the jury that the person could have been the driver. If the prosecution cannot raise the inference, then the government will fail to prove driving which is a required element of its case against the driver in a DUI case.
