Criminal Infractions
A client charged with an infraction is generally not statutorily required to appear in criminal court. When a client's presence is not statutorily required, a court may sentence the client in the client's absence with the client's attorney appearing for the client. Generally a criminal infraction is not grounds for denial, suspension or revocation of a professional license. When a client is arrested for a misdemeanor and the criminal case is resolved by the client' as an infraction, the California Department of Justice should identify the disposition as an infraction on the client's criminal history or rap sheet.
