Domestic Violence Cases and Civil Orders Regarding Children
In some instances involving domestic violence crimes, misdemeanors or felonies, there are civil orders already in effect regarding children and custody and visitation. Some orders may prohibit contact between the parties and even exclude the person from the residence. In these instances, the judge presiding over the criminal domestic violence case may consider issuing a protective order. In doing so, the protective order may outlast the civil order by years because the criminal protective order is in effect as long as the criminal case is pending. However the criminal court judge may issue a peaceful contact order that permits the person to have peaceful contact with the victim for the safe exchange of a child consistent with a family, juvenile or probate order.
