OR or Own Recognizance Release and Nonviolent Felonies
A person who is arrested or charged with a nonviolent felony may be released on his or her OR or Own Recognizance at the discretion of the judge. A judge may apply a number of factors in order to reach a decision as to whether to release a nonviolent offender on his or her OR. The judge may consider the persons ties to the community, the person's record of appearance at past court hearings, whether there is evidence of flight to avoid prosecution, the severity of the possible sentence the person faces. The person seeking OR release bears the burden of producing evidence in court of his or her community ties, employment, residence, property holdings and family attachments If you are arrested or charged with a nonviolent felony, contact Christine McGuire, the Santa Cruz Criminal Defense Attorney/Lawyer, Santa Clara County Criminal Defense Attorney/Lawyer.
