Own Recognizance Release and Misdemeanors
Pursuant to Penal Code Section 1270, a person who is in custody charged with a misdemeanor is entitled to OR or Own Recognizance Release in the absence of a finding by the judge that Own Recognizance release will compromise public safety or will not reasonably assure the person's appearance in court at subsequent court appearances. In determining the probability that a person will return to court if released on his or her Own Recognizance the court considers the person's ties to the community, the person's record of appearances at past court hearings, evidence of flight to avoid prosecution and the severity of possible sentence the person faces.
