Protective Orders in Domestic Violence Cases - Duration
Generally the duration of protective orders in domestic violence cases is limited to the pendency of themisdemeanor or felony domestic violence criminal case in which the protective order is issued. The protective order should state that it remains in effect until the person convicted of the domestic violence related crimes is no longer subject to the court's jurisdiction including the period of probation or incarceration. To terminate a protective order California Judicial Council form CR-165 must be used. The use of this form insures that the termination of the protective order will be entered into CLETS. A protective order must be terminated when the criminal case is dismissed, when the person receives a nonprobationary sentence or when probation expires.
