Theft and Taking From the Person
In a criminal theft case where the government must prove the taking was from the person, the government must prove the property taken was physically attached to the person. For instance, in a case where a purse is taken from the passenger seat next to the driver, the taking was not from the person. However where a person takes a purse placed on the floor next to and touching the person's foot, that is sufficient to establish a taking from the person. In that instance the court found that the person intentionally placed her foot next to her purse, physically touching it and maintaining dominion and control over the purse.
