Theft of Fish, Shellfish and Aquacultural Products
If fish, shellfish, mollusks, crustaceans, kelp, algae are taken from a commercial or research operation that produces such products, the theft of the items is Grand Theft if the value of the fish, etc. exceed $100. Fish taken from public waters are not property that falls within the provision of Penal Code Section 484 and 487. However the Fish and Game Code applies to such thefts. If the fish are taken from private waters or from someone else's possession, the theft falls within the general theft provisions of the criminal law and must exceed $400 in value to be Grand Theft.
