Counterfeiting Laws

Assembly Bill 819 amends Penal Code Section 350. Penal Code Section 350 makes it unlawful to intentionally manufacture, sell or knowingly possess for sale any counterfeit trademark registered with the Secretary of State.  Among other amendments, Assembly Bill 819 adds a new subsection which provides that at the request of  a law enforcement agency and the consent of the registrant, the court can consider a motion to have the items donated to a nonproft organization for distribution to people living in poverty free of charge.  If you are arrested or charged with a violation of an anti-piracy or counterfeiting criminal law, contact Christine McGuire, the Santa Cruz Criminal Defense Attorney/Lawyer, Santa Clara Criminal Defense Attorney/Lawyer
