Jury Trials and Crime Scenes

In a misdemeanor or felony jury trial the judge can order the jury transported to view the crime scene.  The decision to transport a jury to view the scene is up to the discretion of the judge who presides over the misdemeanor or felony jury trial.  The defendant and the defense attorney have a right to be present during the jurors' view of a crime scene.  Should a jury ask to return to the crime scene during jury deliberations, the defendant and the defense attorney have the right to be present with the jurors.  Should  demonstrations occur or jury questions be asked during the crime scene view that were not previously authorized by the judge, the defense attorney will object at that time.  If you are arrested or charged with a misdemeanor or felony, contact The Santa Cruz Criminal Defense Attorney, Santa Cruz Criminal Defense Lawyer, San Jose Criminal Defense Attorney, San Jose Criminal Defense Lawyer.
