Peremptory Challenges and Jury Selection

In a misdemeanor or felony jury trial  for crimes such as Domestic Violence, Driving Under the Influence, Drug Offenses, DUI With Injury, Vehicular Manslaughter, selection of jurors from a jury panel occurs during a process referred to as voire dire.  During voire dire, the defense attorney and prosecutor are permitted to make a challenge to an individual juror known as a peremptory challenge. Should the defense attorney for instance make a peremptory challenge, the attorney does not state a reason for the challenge on the record.  If the charged offense is punishable with a maximum sentence of 90 days or less in jail, the attorneys are entitled to six peremptory challenges each.  If the charged offense is punishable with imprisonment for life or death, the attorneys are entitled to 20 peremptory challenges each.
