Preliminary Alcohol Screening Device/DUI
A preliminary alcohol screening device, also referred to in a DUI case as a PAS is used in DUI investigations by law enforcement. A PAS is a handheld portable breath-testing machine. It is generally used as a field sobriety test in a DUI investigation. A law enforcement officer who decides to use a PAS during the course of the DUI investigation must advise the person that the officer is requesting the person take the test to assist the officer in determining if the person is under the influence o and that doing so does not negate the person's obligation to submit to a blood or breath test under California's implied consent law. The officer must also advise the person that he or she has the right to refuse to take the PAS during the DUI investigation. PAS units are maintained and calibrated by the law enforcement agencies who use them. In jurisdictions that use the PAS as both a screening device and evidentiary breath-testing device, a crime laboratory will maintain and service the PAS unit.
