Rights of Persons Charged With Infractions

There are limits to the rights of persons charged with infractions rather than misdemeanors.  An infraction is an offense that is not punishable by incarceration in the county jail.  Because a person charged with an infraction is not facing jail time, that person is not afforded the same constitutional rights as a person who is charged with a misdemeanor or felony.  A person who is charged with an infraction is not entitled to a jury trial.
