Driving Under the Influence and Restitution
The motorist drove a vehicle while DUI or driving
under the influence and hit and injured the victim. At the time of the incident the motorist was driving his employer's car. The employer's insurance company covered the motorist. The victim received monies from the motorist's employer's insurance company to compensate the victim for injuries sustained. The court in People v. Short held that the amount of restitution the motorist must pay to the victim injured in this driving under the influence restitution case must be offset by the money the victim received from the motorist's employers insurance company.
