A person accused of a criminal offense has a right under the United States Constitution to be informed of the nature of the accusation or charges and the cause of the accusation or charges. Arraignment on the charges occurs when a judge reads the accusatory pleading or the complaint to the person charged and asks whether the person pleads guilty or not guilty. Under the Influence may appear through his or her attorney at all stages of the misdemeanor case including arraignment on the misdemeanor charges. However there are exceptions. For instance, a person charged with a misdemeanor involving domestic violence or a misdemeanor violation of a protective order must be personally present at the arraignment and sentencing.
