Speeding on Bridges, Tunnels and Overpasses
VC 22405(a) provides that no person shall drive a vehicle on any bridge, elevated structure, tube or tunnel constituting a part of a highway at a speed that is greater than the maximum speed that can be maintained with safety to such structure. VC section22405(b) provides that upon the trial of any person charged with a violation of this section, proof of the determination of the maximum speed by the Department of Transportation or local authority and the erection and maintenance of the speed signs shall constitute prima facie evidence of the maximum speed that can be maintained with safety to the bridge, elevated structure, tube or tunnel. Law enforcement may give a ticket for driving over the speed limit posted on a bridge, freeway overpass or tunnel. This violation is very similar to a violation of the basic speed law. The posted speed limit is not absolute; speed over the speed limit is presumed to be unsafe and this presumption may be rebutted.
