Defendants Privilege Not To Be Called as Witness
The Fifth Amendment privilege against being called as a witness is available to a charged defendant in that case against the charged defendant. For witnesses rather than the charged defendant in the defendant's case, there is no privilege not to be called to the witness unless there is a showing that the subpoena is improperly issued. A witness must appear in response to the subpoena and must then assert the Fifth Amendment privilege on the witness stand in response to questions.
