Electronic Data From Vehicles
The 6th District Court of Appeal in San Jose overturned avehicular manslaughter conviction concluding that the prosecution relied on electronic data from the defendant's car that was seized improperly without a search warrant. An expert retrieved the speed data from the "black box" from the defendant's vehicle after the vehicle had been in police custody for a year without a search warrant. The appeals court concluded that privacy rights and constitutional protections against illegal search and seizure required that the police obtain a search warrant prior to retrieving the data from the "black box".
