Reduction of Felony to Misdemeanor
A wobbler is an offense that is chargeable either as afelony or as a
misdemeanor without the imposition of the sentence. When a judge grants felony probation on a crime that is a wobbler, the judge may later declare the offense to be a misdemeanor. The judge however cannot reduce a felony to a misdemeanor when a prison sentence has been imposed. The judge may not reduce a nonwobbler to a misdemeanor. Also the judge may not reduce a felony to a misdemeanor when a judge has sentenced the person to a term in state prison and suspended execution of the prison sentence.
