Sealing Records after Successful Completion of Penal Code Section 1000 or 1000.5 Program

Once a person successfully completes a drug diversion program pursuant to Penal Code Section 1000.5 or a deferred entry of judgment program pursuant to Penal Code Sections 1000, 1000.8, the Court on written or oral motion or on the Court's own motion may order that the records of the arresting agency and the records of the court be sealed pursuant to Penal Code Section 851.90(a).  A person who has successfully completed the programs may state that he or she was not arrested or granted diversion or deferred entry of judgment.
