Consent to Search Person or Place
An exception to the warrant requirement is consent. Consent to enter or search must be specific, unequivocal and freely, voluntarily and intelligently given or consent is invalid. Consent that is given following an unlawful stop or search or given in response to an express or implied assertion of authority is not voluntary consent. The Prosecution has the burden to show that alleged consent was voluntary. A determination of voluntariness by the Court involves the Court examining all the circumstances surrounding the consent.
