DUI- DMV- 10 Day Rule
After a person is arrested for a DUI, the police officer takes your California driver license and will hand the person a pink temporary license from the Department of Motor Vehicles (DMV) which states: Administrative Per Se Suspension/Revocation Order and Temporary Driver License. This license is a 30 day temporary license with full driving privileges Once you hire an attorney he or she will contact the DMV to schedule an Admin Per Se Hearing in order to preserve a person's opportunity to challenge the DMV suspension The Department of Motor Vehicles may be unable to schedule an in person hearing within the thirty day period following the arrest. Your attorney may be able to extend the thirty-day license for as long as is necessary to litigate a DMV hearing.
