PAS Test

 A person who is being investigated for driving a vehicle under the influence of alcohol or drugs (DUI)  is offered an opportunity to provide to law enforcement a sample of his or her breath in the field by blowing into a Preliminary Alcohol Screening Device also known as a  PAS device.  In order to ensure that a DUI suspect's voluntary submission to a PAS device is not misconstrued as compliance with the implied consent law that requires drivers to submit to a blood, breath or urine test during a DUI investigation, the statute requires that advisements be given when a PAS devise is administered.  The officer must advise the DUI suspect that the PAS device does not satisfy the suspect's implied consent obligation and the persons right to refuse to take the preliminary alcohol screening test.
