Second Degree Murder

California prosecutors can charge motorists with second degree murder or vehicular manslaughter.  A killing may amount to second degree murder if the driver acted with malice.  A court may infer implied malice where an unintentional killing occurs from the use of a car if the driver acted with wantonness and an awareness of a higher degree of risk than gross negligence.  Malice can be implied when a person knowing that his conduct endangers the life of another acts deliberately with conscious disregard for life.  If you are arrested or charged with second degree murder or vehicular manslaughter contact Christine McGuire, the Santa Cruz Vehicular Manslaughter Defense Attorney, Christine McGuire, the Santa Cruz Vehicular Manslaughter Defense Lawyer, Christine McGuire, the San Jose Vehicular Manslaughter Defense Attorney, Christine McGuire, the San Jose Vehicular Manslaughter Defense Lawyer.
