Destruction of Juvenile Records

Penal Code Section 851.7 requires destruction five years from the date the judge signes the petition to seal a juvenile record order. Welfare and Institutions Section 793 (c) and 781 requires destruction five years from the date the judge signed the order. Section 781 of the Welfare and Institutions Code requires destruction five years from the date of arrest or citation. Welfare and Institutions Code section 781.5 requires destruction three years from the date of arrest or citation. Welfare and Institutions Code Section 389 requires destruction five years from the date the judge signs the order. PC 1203.45 requires destruction five years from the date the judge signed the order. Destruction of records of arrest is accomplished by permanent obliteration of all entries or notations pertaining to the arrestee.
