Assertion of Miranda Rights
A request for an attorney invokes the privilege to remain silent. The request for an attorney must be made in response to interrogation. A request for counsel upon arrest does not invalidate a later waiver during interrogation. There is a difference between requesting an attorney and invoking the right to remain silent. Any words or conduct that are inconsistent with a present willingness to discuss the case freely and completely with the police may also be an invocation of that right.
