Elder Abuse: Fines and Penalties

Effective for 2012, amended Penal Code Section 368 increases fines for theft, embezzlement, forgery, fraud and identity theft and identity crimes against an elder or dependent adult. Specifically, the new law:
1) Increases the fine for misdemeanor theft, embezzlement, forgery or fraud, and identity theft and identity crimes against an elder or dependent adult when the value of the losses exceed $950, from up to $1,000 to $2,500 plus penalties/assessments. Penalties and assessments amount to 270% of the fine, plus a flat fee of $103.
2) Creates a fine not to exceed $10,000 plus penalties and assessments for felony theft, embezzlement, forgery or fraud, and identity theft and identity crimes against an elder or dependent adult when the value of the loss exceed $950
