Theft Crimes and Fraudulent Refunds

Posted By Christine McGuire || 2-Dec-2010

A person who takes property while in a store and later presents that same property to the clerk in the store for a refund is guilty of a theft crime.  Courts have held that taking of property with the intent to fraudulently obtain a refund constitutes both an intent to permanently deprive the store of property and a trespassory taking.  If you are arrested or charged with a misdemeanor or felony theft related crime including a fraudulent refund theft, contact Christine McGuire, the Santa Cruz Criminal Defense Attorney /Lawyer, Santa Clara Criminal Defense Attorney/Lawyer.
