A defendant may be eligible to participate in a deferred entry of judgment program. Deferred entry of judgement is the suspension of criminal proceedings for a certain period of time with certain conditions after a defendant has entered a guilty plea. If a defendant is denied participation in a deferred entry of judgment program, criminal proceedings resume and the defendant having already pleaded guilty, is sentenced. If the defendant is successful in meeting the terms of the program, criminal charges are dismissed. The defendant subject to certain exceptions may answer that he or she has never been arrested or or charged with the diverted offense. In certain circumstances a Court may order a preplea probation report before a defendant enters a plea.
