Penal Code Section 1538.5 and DUIs

In a DUI case, a Penal Code Section 1538.5 motion will address probable cause for the stop, the PAS test, the chemical test or a combination. The evidence to be suppressed may include symptoms or indicia of intoxication observed by the police officer and the chemical test administation, results and observations surrounding the test. A motion pursuant to Penal Code Section 1538.5 to suppress evidence is a motion required to be in writing. The motion may be made when tangible or intangible evience is seized from the defendant.
