The legal definition of Attempt is related to but different from the legal
definition of Conspiracy. One commits the crime of Conspiracy in California when
1. One makes an agreement with one or more other people to commit a crime and
2. One or one of the persons who made the agreement commits an overt act
in furtherance of the agreement.
Conspiracy requires an agreement with another peson and Attempt does not.
The overt act in furtherance of the conspiracy does not need to be as
direct as a step toward committing the crime as the act required for an
Attempt. It can be a mere act of preparation to commit the crime even
though planning or preparation is not enough to make one guilty of an Attempt.
